The Court of Justice of the EU made a judgement recently on 'Safe Harbour' arrangements for the transfer of personal data from the EEA to the USA. Our legal advisers have produced a note about that ruling.

Following the EU Court decision on Safe Harbour earlier this week, whereby EU-US data transfers are 'invalid' if made under the 'safe harbour' regime, our solicitor has advised that where a cloud arrangement includes the Model Clauses, then the ruling should have limited immediate impact. Following the EU Court decision on Safe Harbour earlier this week, whereby EU-US data transfers are 'invalid' if made under the 'safe harbour' regime, our solicitor has advised that where a cloud arrangement includes the Model Clauses, e.g. Microsoft’s OSTs, then the ruling should have limited immediate impact.
