I had a meeting with Ofcom this morning as part of their review of section 17 of the Digital Economy Act 2010. That section, if enabled by the Secretary of State, would allow courts to order a service provider “to prevent its service being used to gain access to [an Internet] location”.

In its response to the House of Lords Merits of Statutory Instruments Committee (no, I hadn't heard of it before) assessment of the Cost Sharing Statutory Instrument, the Government has confirmed that it remains aware of the problems of fitting libraries and other wifi providers into the Digital Economy Act 2010.

The Department for Culture, Media and Sport has today announced that Ofcom will be asked to review the practicality of the provisions in section 17 of the Digital Economy Act 2010 that might in future allow courts to order blocking of infringing sites.

I've done a couple of presentations in the past week to audiences who turn out to raise similar problems for a literal reading of the Act. Looking at the duties imposed by the Act on "ISPs" it's clear that these imply that the ISP is both

In talking about the Digital Economy Act at Networkshop I mentioned that from my limited knowledge of employment law the Act seemed to raise a few problems for employers. It turned out that one of the audience knew a real lawyer who has now looked into this and written an article confirming my fears.

Having now gone through Ofcom's consultation paper on the draft Initial Obligations Code, there seems to be both good news and bad news.
